The Court of Appeal of Quebec recently issued its decision in SNC-Lavalin inc. c. Société québécoise des infrastructures (Société immobilière du Québec), awarding close to 9 million dollars plus interest in compensation to the Société immobilière du Québec and the Centre de santé et de services sociaux de Trois-Rivières. These plaintiffs’ claim arose from defects in the foundations of an annex to a building operated by the Centre.
Patrick Henry, who was representing co-defendant IMS experts-conseils inc., had successfully argued before the Superior Court that his client had no responsibility in the errors committed during construction. The Court of Appeal just confirmed this conclusion.
