The Superior Court recently issued its decision in 86296 Canada Ltd. c. Shoppers Realty Inc., on an exclusivity clause in a commercial lease for a Pharmaprix outlet. The key issues were whether two shopping centres owned by the Plaintiffs were on “abutting lands” and whether one shopping centre was “owned or controlled by the Landlord [of the other centre] or any party which is Affiliate of Landlord”.
Jonathan J. Robinson acted on behalf of the plaintiffs, obtaining a declaratory judgment in their favour.
