Jean-François Germain

Jean-François has handled cases involving the full spectrum of insurance-related litigation. In particular, he has pleaded cases illustrating very specific points of law:

• Successfully defended a private partner in a PPP against a claim alleging a violation of the contract and requesting the installation of noise barriers along the road built pursuant to the partnership. Ville de Salaberry-de-Valleyfield c. Procureur général du Québec, 2020 QCCA 1269.
• Successfully defended a carrier sued following a theft in which one of its employees was an accomplice. Zurich Canada inc. c. Services Transport André Marcoux ltée, 2016 QCCS 2566.
• Represented a contractor and its liability insurer in a case where the Court ruled that a subcontractor was an unnamed insured under a builder’s policy, thus barring the recovery claim filed against it. Optimum, société d’assurances inc. c. Plomberie Raymond Lemelin inc., 2009 QCCA 416, [2009] R.R.A. 63, [2009] R.J.Q. 609.
