RSS continues to excel before the courts

The hard work and experience of RSS’s litigators continue to yield positive results.

  • Yesterday, the Superior Court dismissed at the preliminary stage a $325,000 claim filed by a teacher against his employer, John Abbott College. The plaintiff was alleging having been targeted by illegal disciplinary measures, defamation, discrimination and psychological harassment by the college. The Court allowed the application for dismissal, ruling that the plaintiff’s claims came within the exclusive jurisdiction of a grievance arbitrator. Martin Côté, David Paradis and Jacques Bélanger were acting in this matter.
  • Very recently, Martin Côté, once again assisted by David Paradis, also had a libel case end at the preliminary stage when a citizen who had filed a lawsuit against a Westmount City counsellor for $175,000 abandoned his claim. RSS had already had this case summarily dismissed against the mayor and the City.
  • Finally, after a three-day hearing, the Superior Court dismissed an application for interlocutory injunction against our client, the City of Châteauguay, represented by Pierre Brossoit, Fabienne Beauvais and Xavier Morand Bock. The applicant was asking that the City be compelled to alter its sewer system, to prevent rain water from certain streets to flow on its vacant plot of land. Although it demonstrated an appearance of right, the Court ruled that it had not proven serious or irreparable harm, a condition for the issuance of an interlocutory injunction.
