Anaïs Kadian is a lawyer in our Commercial and Civil Litigation, and our Estates, Wills and Trusts Groups. Her practice focuses on succession and estate cases, commercial contract disputes, and construction and condominium files. Anaïs provides strategic counsel to individuals and institutions including estate liquidators, corporate directors, shareholders, construction contractors, property owners, and condo syndicates.

A trilingual and persuasive attorney, she has skillfully and eloquently represented clients at all levels of court in Quebec. Early in her career, she clerked for the judges of the Superior Court of Quebec, gaining valuable insight into judicial processes. Her well-rounded experience and dedication make her a trusted advisor and advocate for her clients.

Litigation in Estates, Wills and Trusts

  • Representing beneficiaries of trusts in applications to terminate and modify trusts, replace trustees, and order the distribution of assets
  • Representing estate heirs in applications to annul a will on the grounds of incapacity and undue influence
  • Representing estate heirs and obtained the nullity of a will and marriage (establishing a precedent in Quebec) given the testator’s incapacity, as well as the payment of moral damages and legal fees for abuse of procedure Droit de la famille — 21535, 2021 QCCS 1305
  • Representing an institutional liquidator of an interprovincial estate in an application for the probate and for the interpretation of wills
  • Representing heirs in applications for safeguard orders to appoint provisional estate liquidators
  • Representing heirs of an estate in the context of renunciations to inheritances
  • Representing clients requesting the homologation of protection mandates and the institution of tutorship regimes

Civil and Commercial Litigation

  • Representing a company in injunction and contempt of court proceedings to halt the publication of defamatory statements published online
  • Representing clients and shareholders in claims for breach of commercial contracts, actions on account, and oppression actions
  • Representing a placement agency for employees and obtained payment for services rendered
  • Obtaining the personal condemnation of a guarantor for the non-payment of supplies purchased by their company
  • Obtaining the dismissal of an action on account brought against the executive director of a non-profit organization 
  • Defending a company owning a former quarry being sued for loss of profits

Litigation in Real Estate, Co-Ownership, and Construction Files

  • Representing co-ownership syndicates in proceedings for construction defects affecting their buildings and the registration of legal hypothecs
  • Representing general contractors in actions brought by subcontractors claiming damages for delays, construction defects, and breach of contract in governmental construction projects
  • Representing a contractor and obtained the surrender and judicial sale of a property encumbered by a construction hypothec
  • Representing clients in a hidden defects case and obtained judgment in first instance and on appeal ordering the seller to reimburse the cost of repairs
  • Representing landlords and tenants in commercial lease disputes, litigation for arrears of rent, eviction, illegal subletting, lease termination, and repossession

Class Actions

  • Representing consumers and obtained damages from Meubles Léon Ltd. for violations of the Consumer Protection Act Consommateurs c. Meubles Léon ltée, 2017 QCCS 3526 
  • Representing plaintiffs in an application for the authorization of a class action against a construction materials recycling company for the pollution of neighbouring properties
  • Representing a group of investors alleging to have been victims of a Ponzi scheme and managed the distribution campaign of a class action settlement amounting to approximately $43 million
  • Representing a consumer group in the implementation of a national marketing plan ($1 million) for the distribution of the settlement of a competition law class action valued at $38 million
