COVID-19 —Family Law Communiqué

Dear clients,

The current crisis affects almost all aspects of our lives.

However, we would like to take this opportunity to let you know that we continue to be here to serve you during these difficult times. The COVID-19 virus and the public health measures adopted to combat it may raise questions concerning custody, parental authority, alimentary obligations or the negotiation of your divorce (or any other matter that may arise) in the coming weeks.

Current government measures allow us to continue our operations and, although we  will have to adapt to the situation, please be aware that we remain available to answer your questions. We invite you to contact us by email or leave a message in our respective voice mailboxes and then we could schedule a telephone appointment, if necessary.

Several of you have asked us questions about childcare arrangements. In this regard, we would like to add our voice to the government directives available on Justice Québec website, and remind you that:

  • The current custody schedules continue to apply in principle;
  • It may however be opportune for parents to discuss and see if a new schedule minimizing the number of exchanges can be envisaged;
  • In the event of conflicts, parents should favour negotiation or mediation, a process in which we can guide you.

The recommendations contained above will of course need to be adapted to public health directives, in particular as regards to periods of isolation or if one of the parents develops symptoms of COVID-19 as well as any directive to come.

In addition to custody issues, public health measures and market developments may impact your financial situation.

If you have any questions about how the current crisis could affect your alimentary rights or obligations or the partition of your assets, we invite you to contact us. Each case remains unique, but rest assured that we are well aware of the issues and remain committed to provide you with the best possible legal services given the circumstances.

We conclude by reiterating that we will remain at your disposal and that we will make our best efforts to adapt in order to continue responding to your needs. We wish you health and peace of mind during this difficult time.
