Representative files and mandates

  • Lamothe v. Beaudoin, 2025 QCCS 1245 (CanLII): The court dismissed the plaintiffs’ personal injury claim in the amount of $1,100,420.76. Cross-examination revealed several contradictions, inconsistencies and omissions that seriously undermined the credibility of the plaintiff, to the point where the court concluded that she had failed to meet her burden of proof.

  • Bédard Collin v. Wawanesa Mutual Insurance Company, 2024 QCCQ 3927 (CanLII): The court declared the automobile insurance contract void ab initio, finding that the plaintiff had made false statements at the time of underwriting by failing to disclose a criminal record for theft.

  • Lemoine v. Commission scolaire de la Rivière-du-Nord, 2023 QCCS 4795 (CanLII): The plaintiff’s civil liability claim for over one million dollars against two former teaching colleagues who reported his behaviour toward a fifth-grade student was dismissed. The court found no evidence suggesting the teachers had been untruthful. Moreover, the court held that in a school setting, immunity extends to all individuals whose actions are part of a report to Youth Protection concerning a child’s endangerment.

  • Theodorakopoulos v. Wawanesa Insurance, 500-17-117491-210, C.S., December 16, 2021, Justice David R. Collier: The court found the plaintiff to be abusive, declared them a vexatious litigant, and ordered the payment of punitive damages to the insurer.

  • Claveau v. Pilote, 2020 QCCS 1176: The court dismissed the plaintiff’s personal injury claim and granted the defendants’ counterclaims, concluding that the plaintiff had pursued the proceedings in an abusive, excessive, and unreasonable manner.
