{"id":30839,"date":"2025-09-26T11:36:30","date_gmt":"2025-09-26T15:36:30","guid":{"rendered":"https:\/\/www.rsslex.com\/?p=30839"},"modified":"2025-10-16T11:48:50","modified_gmt":"2025-10-16T15:48:50","slug":"is-planned-obsolescence-finally-coming-to-an-end-on-october-5-2025","status":"publish","type":"post","link":"https:\/\/www.rsslex.com\/en\/bulletins-en\/is-planned-obsolescence-finally-coming-to-an-end-on-october-5-2025\/","title":{"rendered":"Is Planned Obsolescence Finally Coming to an End on October 5, 2025?"},"content":{"rendered":"<p>While a dishwasher from the 1980s can still run smoothly, many newer models seem to break down after just a few cycles!<\/p>\n<p>The 2023 adoption of the <em>Act to Protect Consumers Against Planned Obsolescence and to Promote the Durability, Repairability and Maintenance of Goods<\/em><sup>1<\/sup>\u00a0(hereinafter the &#8220;<strong>Anti-Obsolescence Act<\/strong>&#8220;), which modified the <em>Consumer Protection Act<\/em><sup>2<\/sup>\u00a0(the &#8220;<strong>C.P.A.<\/strong>&#8220;), aimed specifically to address this very phenomenon of planned obsolescence.<\/p>\n<p>The new provisions introduced by the Act impose a range of obligations on manufacturers and merchants regarding the maintenance and repair of goods.<\/p>\n<p>Starting October 5, 2025, the <em>Regulation amending the<\/em><em>Regulation respecting the application of the Consumer Protection Act<\/em><sup>3<\/sup> (the &#8220;<strong>Regulation<\/strong>&#8220;) will officially come into force, bringing significant changes to how manufacturers and merchants operate\u2014with substantial fines for non-compliance<sup>4<\/sup><a href=\"#_ftn4\" name=\"_ftnref4\"><\/a>.<\/p>\n<h2><strong>Reminder of the New Principles<\/strong><\/h2>\n<p>The Anti-Obsolescence Act focuses on ensuring that consumers have easy access to four key elements related to the maintenance and repair of goods<sup>5<\/sup>:<\/p>\n<ol>\n<li>Replacement parts;<\/li>\n<li>Repair services;<\/li>\n<li>Information necessary for the maintenance and repair of a good that may require servicing; and<\/li>\n<li>Tools needed to install replacement parts.<\/li>\n<\/ol>\n<h2><strong>New Regulatory Provisions in Force as of October 5, 2025<\/strong><\/h2>\n<h3 style=\"padding-left: 40px;\"><strong>1) &#8220;Tool&#8221;<\/strong><\/h3>\n<p>Under the Act, tools required for the installation of replacement parts must be &#8220;commonly available&#8221;<sup>6<\/sup><a href=\"#_ftn6\" name=\"_ftnref6\"><\/a> to consumers.<\/p>\n<p>The Regulation<sup>7<\/sup>\u00a0now clarifies that:<\/p>\n<p style=\"padding-left: 40px;\">a) The tool must be provided free of charge no later than upon the consumer taking possession of the good; or<\/p>\n<p style=\"padding-left: 40px;\">b) It must be available at a reasonable price and within a reasonable time frame, through a remote contract (i.e., an online transaction).<\/p>\n<h3 style=\"padding-left: 40px;\"><strong>2) Disclosure of Information by Manufacturers<\/strong><\/h3>\n<p>Under the Act, manufacturers must inform consumers about the availability of replacement parts and repair services, and provide the information required for the maintenance or repair of goods whose availability they guarantee<sup>8<\/sup>.<\/p>\n<p>The Regulation further specifies that full, partial, or no availability of these elements must be disclosed online, in a clear and intelligible manner<sup>9<\/sup><a href=\"#_ftn9\" name=\"_ftnref9\"><\/a>.<\/p>\n<p>If a manufacturer only partially guarantees the availability of any such element, they must also specify online\u2014again, in a clear and intelligible manner\u2014which elements are not fully guaranteed<sup>10<\/sup>.<\/p>\n<p>This information must be presented in a way that allows it to be easily printed or saved, and must also be included in the user and maintenance manuals for the goods<sup>11<\/sup>.<\/p>\n<h3 style=\"padding-left: 40px;\"><strong>3) Disclosure of Information by Merchants<\/strong><\/h3>\n<p>Merchants are subject to the same disclosure obligations as manufacturers regarding the full, partial, or absent guarantee of availability for replacement parts, repair services, and maintenance\/repair information\u2014but must provide this information \u201cin writing\u201d<sup>12<\/sup><a href=\"#_ftn12\" name=\"_ftnref12\"><\/a>.<\/p>\n<p>The Regulation also specifies, as it does for manufacturers, that if any of these elements is only partially guaranteed, the merchant must indicate in writing which elements are not fully guaranteed<sup>13<\/sup>.<\/p>\n<p>In addition, merchants must publish, \u201cnear that information\u201d, a hyperlink leading directly to the manufacturer\u2019s published information<sup>14<\/sup>.<\/p>\n<p>Based on our interpretation of the Regulation, if merchants publish all required information online in a clear and understandable format that allows consumers to easily print or save it, they are not obligated to provide it on physical media<sup>15<\/sup>.<\/p>\n<h2><strong>Conclusion<\/strong><\/h2>\n<p>Manufacturers and merchants will need to work closely together to ensure compliance with the new mandatory disclosure requirements on maintenance and repair, starting October 5, 2025. It will also be interesting to see how tools required for repairs will be made accessible to consumers and if manufacturers do in fact modify their user manuals on time.<\/p>\n<p>On September 16, 2025, the Retail Council of Canada (RCC) and the Canadian Federation of Independent Business (CFIB) publicly opposed the Regulation, calling its implementation &#8220;impossible&#8221; for Quebec merchants<sup>16<\/sup>.<\/p>\n<p>It will indeed be interesting to observe how these new obligations will be enforced by manufacturers and merchants, and what impact they will have on consumer practices in Quebec.<\/p>\n<p>The changes for merchants aren\u2019t stopping there! Starting next year<sup>17<\/sup>, a new guarantee of \u201cgood working order\u201d will apply to certain new goods\u2014such as household appliances and cellphones\u2014sold or leased under long-term contracts<sup>18<\/sup>.
