En r\u00e9ponse \u00e0 ces besoins grandissants, plusieurs logiciels sont mis \u00e0 la disposition des employeurs pour assurer une surveillance du t\u00e9l\u00e9travail. Leur utilisation n\u2019est pas sans risque.<\/p>\n<p>Bien que tout employeur d\u00e9tienne un droit de gestion reconnu, celui-ci n\u2019est pas illimit\u00e9. Selon la Commission des normes, de l\u2019\u00e9quit\u00e9, de la sant\u00e9 et de la s\u00e9curit\u00e9 du travail, le droit de gestion est \u00ab&nbsp;le droit de l\u2019employeur de diriger ses travailleuses et travailleurs et de prendre des d\u00e9cisions pour assurer la rentabilit\u00e9 de son entreprise et la bonne marche de ses affaires. Il permet \u00e0 l\u2019employeur d\u2019encadrer son personnel pour qu\u2019il se conforme aux r\u00e8gles en vigueur dans l\u2019entreprise.&nbsp;\u00bb<\/p>\n<p>Comment surveiller ce qui est fait \u00e0 distance tout en respectant les droits fondamentaux prot\u00e9g\u00e9s par la <em>Charte des droits et libert\u00e9s de la personne<\/em> (respect de la vie priv\u00e9e)?<\/p>\n<p>Il est important de reconna\u00eetre que les expectatives du respect \u00e0 la vie priv\u00e9e des employ\u00e9s sont plus grandes lorsque le travail est effectu\u00e9 \u00e0 leur r\u00e9sidence que lorsqu\u2019ils sont physiquement dans les lieux de travail de l\u2019employeur, et ce, \u00e0 juste titre.<\/p>\n<p>\u00c0 ce jour, les tribunaux ne se sont pas encore prononc\u00e9s sur les limites entre l\u2019\u00e9quilibre du droit \u00e0 la surveillance de l\u2019employeur et du droit \u00e0 la vie priv\u00e9e de l\u2019employ\u00e9. Toutefois, il a \u00e9t\u00e9 reconnu qu\u2019un logiciel de s\u00e9curit\u00e9 informatique et de surveillance install\u00e9 sur les ordinateurs de travail fournis par l\u2019employeur est une mesure l\u00e9gale dans les limites o\u00f9 une politique en bonne et due forme tient inform\u00e9e les employ\u00e9s au pr\u00e9alable de ces directives d\u2019utilisation des outils mis \u00e0 leur disposition. De ce fait, les employ\u00e9s savent que l\u2019historique de leur navigation et l\u2019utilisation des outils peuvent \u00eatre surveill\u00e9s, et ce, en tout temps.<\/p>\n<p>Par contre, aucune m\u00e9thode de surveillance, tant informatique que physique, ne doit \u00eatre abusive ni ne cibler qu\u2019un seul salari\u00e9. Aucun dispositif de cam\u00e9ra ou d\u2019enregistrement ne doit \u00eatre utilis\u00e9.<\/p>\n<p>Pour utiliser de tels logiciels, l\u2019employeur doit avoir des motifs raisonnables de le faire. \u00c0 titre d\u2019exemple, il peut \u00eatre justifi\u00e9 de l\u2019utiliser pour assurer la s\u00e9curit\u00e9 informatique du r\u00e9seau ou encore comptabiliser les heures travaill\u00e9es pour pr\u00e9venir ou encore constater de possibles vols de temps.<\/p>\n<p>Cette nouvelle r\u00e9alit\u00e9 du monde du travail apportera sans doute plusieurs ajouts et\/ou modifications l\u00e9gislatifs. D\u2019ailleurs, \u00e0 compter du 22 septembre 2023, la <em>Loi sur l\u2019acc\u00e8s aux documents des organismes publics et sur la protection des renseignements personnels <\/em>sera modifi\u00e9e pour ajouter l\u2019article 65.0.1 qui se lit comme suit\u00a0:<\/p>\n<table>\n<tbody>\n<tr>\n<td width=\"10%\"><\/td>\n<td width=\"80%\">65.0.1. En plus des informations devant \u00eatre fournies suivant l\u2019article 65, quiconque recueille des renseignements personnels aupr\u00e8s de la personne concern\u00e9e en ayant recours \u00e0 une technologie comprenant des fonctions permettant de l\u2019identifier, de la localiser ou d\u2019effectuer un profilage de celle-ci doit, au pr\u00e9alable, l\u2019informer\u00a0:<\/p>\n<p>1\u00b0 du recours \u00e0 une telle technologie;<\/p>\n<p>2\u00b0 des moyens offerts pour activer les fonctions permettant d\u2019identifier, de localiser ou d\u2019effectuer un profilage.<\/p>\n<p>Le profilage s\u2019entend de la collecte et de l\u2019utilisation de renseignements personnels afin d\u2019\u00e9valuer certaines caract\u00e9ristiques d\u2019une personne physique, notamment \u00e0 des fins d\u2019analyse du rendement au travail, de la situation \u00e9conomique, de la sant\u00e9, des pr\u00e9f\u00e9rences personnelles, des int\u00e9r\u00eats ou du comportement de cette personne.<\/td>\n<td width=\"10%\"><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Il est possible de conclure de cette disposition que les employeurs devront redoubler de prudence quant \u00e0 la t\u00e9l\u00e9surveillance et aux informations sur le rendement au travail qu\u2019ils pourront \u00eatre \u00e0 m\u00eame de colliger \u00e0 l\u2019aide des outils informatiques utilis\u00e9s.<\/p>\n<p>Pour vous tenir d\u00fbment inform\u00e9s des d\u00e9veloppements juridiques \u00e0 venir quant aux enjeux du t\u00e9l\u00e9travail ou encore pour de plus amples informations sur ce sujet, n\u2019h\u00e9sitez pas \u00e0 vous r\u00e9f\u00e9rer \u00e0 un conseiller juridique qui pourra s\u2019assurer que vos m\u00e9thodes de travail sont efficaces et conformes aux normes et aux droits fondamentaux.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Only available in French Avec la place importante qu\u2019a prise le t\u00e9l\u00e9travail depuis le d\u00e9but de la pand\u00e9mie et la p\u00e9rennit\u00e9 qui s\u2019installe, plusieurs employeurs aimeraient surveiller davantage les employ\u00e9s qui travaillent \u00e0 distance.
