Pierre Brossoit is a partner in our Insurance Law Group, and a mediator and arbitrator accredited by the Institut de médiation et d’arbitrage du Québec (IMAQ). His practice focuses primarily on mediation and arbitration, as well as the defense of class action lawsuits.

Business clients appreciate his rich experience and consult him for strategic advice or to review, interpret and negotiate commercial agreements. He is also an ethics advisor, accompanying businesses issuing requests for proposals towards major construction or service contracts. His role is to oversee the objectivity of the decision process and assure businesses that all bidders are treated fairly.

In 2018, he was appointed as one of the 13 adjudicators authorized to rule on contested claims filed by contractors and subcontractors pending the completion of construction contracts with the Quebec Government. As an adjudicator, Pierre has issued decisions on numerous requests for payment by contractors or subcontractors as parties to public construction contracts, in cases that depended on the interpretation of contract clauses, in claims based on unforeseen circumstances, or on the costs of compliance with sanitary measures.

In the spring of 2022, Pierre collaborated with IMAQ to produce three videos in French, explaining to contractors how to prepare for a hearing before an adjudicator:

Mediation and Adjudication

With recognized training in mediation and arbitration, Pierre acts as a mediator or arbitrator in civil and commercial matters.

Pierre is a member of the Groupe d’Arbitrage — Juste Décision (GAJD), which specializes in alternative dispute resolution mechanisms, such as mediation and arbitration. He has served as an arbitrator for numerous cases, especially those related to Quebec’s warranty plan for new dwellings and in various private litigation matters related to complex, high-stake cases. His decisions are available on the GAJD website. Since 2024, he has also been authorized by the Ministry of Labour to act as mediator in the application of the warranty plan for new residential buildings.

The Canadian Center for Commercial Arbitration (CCAC) also calls upon Pierre to act as a mediator or arbitrator in various dispute cases.

Adjudicator

Since his appointment in 2018, Pierre has rendered several opinions on claim files for more than $750,000.

Ethics Advisor

Advised Aéroports de Montréal (ADM), ensuring and confirming the fairness of the bidding process for major construction contracts.

Class Actions

Pierre has appeared as lead counsel in recent or ongoing major class actions, representing:

  • The Groupement des assureurs automobiles du Québec against a claim based on an alleged liability arising from the mandatory designation of the repair shop to insureds after an automobile accident
  • The Autorité régionale de transport métropolitain (ARTM), against a claim based on alleged failures to provide the scheduled commuter train service on the Deux-Montagnes and Mascouche lines
  • The ARTM, against a claim based on the annoyance allegedly suffered by users due to the interruptions of the commuter train service caused by the construction of the Réseau express métropolitain (REM)
  • The Association des optométristes du Québec, against a claim based on alleged illegal invoicing for services already insured by the Régie d’assurance maladie du Québec
  • Camso Inc., against a claim based on the alleged default (premature failure) of a part used on some snowmobiles
