2023: Here we come

Quebec’s legal panorama has been particularly rich in developments over the past few months. Numerous legislative amendments will continue to influence the daily life of individuals and businesses alike. Some of them stand out:

  • The Act respecting the laicity of the State, a hot topic since its enactment in 2019, is presently being challenged before the Court of Appeal of Quebec. Among the issues it raises, the prohibition against the wearing of religious symbols in the exercise of certain functions has certainly fostered the most passionate discussions. Members of our team have helped institutions adapt to this new reality: we are able to advise you on the sensitive issues that your organization could face.
  • The Act respecting French, the official and common language of Québec, adopted in June of this year, will have a major impact on business operations and communications. Lawyers from our Business Law and Labour and Employment Law groups have combined their respective skills to accompany our clients and help them understand their new obligations and the impact that those will have on their daily affairs. The gradual coming into force of a series of changes to the Act respecting the protection of personal information in the private sector has also prompted these groups to reach out to their clients to help them comply with these new obligations dictated by a perpetually changing technological environment.
  • The Divorce Act has undergone sweeping changes that have been widely hailed as major progress, related to aspects such as the criteria with respect to the best interests of the child, the use of dispute resolution processes, family violence, and relocations. Our Family Law Group continues to accompany businesspeople with complex assets who need advice and assistance when undergoing a separation, or when planning to enter into a new relationship.

We are anticipating the coming year with renewed energy. We look forward to advising you on the continuing evolution of the legal panorama and discussing how it affects your particular situation.

With this in mind, I thank you for your trust and wish you, on behalf of RSS, all the best for 2023.

Andrew Penhale
