Jean-François Germain is a Partner in our Insurance Law Practice Group. His practice focuses on the representation of businesses as well as insurers and their insureds before the courts of Quebec and in mediation and arbitration proceedings.
He specializes on construction law, product liability, professional liability and general insurance law. Jean-François Germain is accredited by the Quebec Bar as a mediator in civil matters.
Jean-François Germain has managed cases representing the majority of issues related to insurance. More particularly, he has argued cases illustrating exceptional points of law:
- Successful defence of a private partner in a PPP against a claim alleging a violation of the contract and requesting the installation of noise abatement walls along the road built pursuant to the partnership. Ville de Salaberry-de-Valleyfield c. Procureur général du Québec, 2020 QCCA 1269.
- Successful defence of a carrier sued as employer following a theft in which one of its employees was an accomplice. Zurich Canada inc. c. Services Transport André Marcoux ltée, 2016 QCCS 2566.
- Representation of a contractor and its liability insurer in a case where the Court ruled that a subcontractor was an unnamed insured under a builder’s policy, thus barring the recovery claim filed against it. Optimum, société d’assurances inc. c. Plomberie Raymond Lemelin inc., 2009 QCCA 416,  R.R.A. 63,  R.J.Q. 609.
